Collegium remits two names recommended for elevation to Orissa, Calcutta HCs

The Supreme Court Collegium has remitted two names recommended for elevation – one each to the Calcutta High Court and the Orissa High Court – to the respective High Court Collegia.

Judicial Officer Rabindranath Samanta was recommended for elevation to the Calcutta High Court on April 5, 2018. On October 24 last year, the Supreme Court Collegium had decided to defer the recommendation.

Now, in light of the fact that officers senior to Samanta have been overlooked, the Collegium has deemed it fit to remit his name to the High Court.

“…it is observed that names of many Judicial Officers senior to Shri Rabindranath Samanta have been ignored. In our considered opinion, the above proposal deserves a fresh look by the High Court Collegium. The Collegium recommends that the same be remitted to the Calcutta High Court.”

Similarly, Advocate Kali Prasanna Mishra was recommended for elevation to the Orissa High Court on May 5 last year, and the same was deferred by the Supreme Court Collegium on October 31. Although it hasn’t given a reason for doing so, the Collegium has now chosen to remit Mishra’s name to the High Court Collegium.

“…we have carefully scrutinized the material on record including the observations made by the Department of Justice in the file. Having regard to all relevant factors, the Collegium is of the considered view that the above proposal deserves to be remitted to the Orissa High Court.”
