Allegations against CJI Ranjan Gogoi: TNAA calls for contempt proceedings against complainant

The Tamil Nadu Advocates’ Association (TNAA) has addressed a representation calling on the Supreme Court to initiate contempt proceedings against the former woman staffer who has accused Chief Justice Ranjan Gogoi of sexual harassment..A letter signed off by TNAA president, S Prabakaran states,.“… the complainant first refused to take part in the proceedings and she started flinging mud at the institution..Now, after the Bench delivered Judgment, She expresses dissatisfaction and distrust at the proceedings..Her’s is an unadulted act of contempt of court, as she has indulged in mud-slinging and defamation, bordering character assassination of the Chief Justice of India, other Judge who heard the case… besides the very dignity and majesty of Hon’ble Supreme Court of India itself. .Her actions have to be deprecated in no uncertain terms, as, otherwise, they would bring disrepute to the highest court of the land and lower its authority and independence. (sic]”.By the letter, the TNAA has also come out in support of the “robust, constitutional” precedent set by CJI Gogoi in dealing with the sexual harassment allegations. It states,.“The Hon’ble Chief Justice of India not only stepped aside and allowed a 3 Judge Bench to hear the complaint, but ensure that the Bench had majority of women judges to male judges at the ratio of 2:1. The Honourable Justice BV Ramana, who’s the second senior most Judge, recused himself from the Bench even though the complainant woman had levelled only unfair allegations that he should not be in the bench [sic].”.It goes to state that the complainant’s acts to “tar the institution” cannot be condoned. Therefore, the TNAA has called on the Supreme Court to initiate contempt proceedings against the complainant. To this effect, the letter states,.“A fair and due process of law have been afforded in her case though her complaint was reckless. She sought to bring in external forces and extraneous factors to bring pressure on the Honb’le Supreme Court to head her complaint. Now… she is using the same external factors to tar the very institution. This can never be permitted. (sic)..Hence the Tamil Nadu Advocate’s Association (TNAA) requests the Honb’le Supreme Court to initiate contempt of court proceedings against the women for indulging in unfair and motivated criticism of the course, Judgments in her case. (sic)”.The TNAA further adds that the Court should direction initiation of disciplinary proceedings against those “indulging in character assassination of the Hon’ble Chief Justice of India without any basis in this matter.” As stated in the letter,.“Many Practising and Non-Practising Lawyers and also the ex-judges are talking to social media and mass media with half-truths.
