Ahead of the all-important hearing in Supreme Court in CBI Director Alok Verma’s petition, another CBI officer has now approached the Supreme Court..Ashwini Kumar Gupta, DYSP CBI has sought intervention in Verma’s petition challenging his repatriation to his parent organisation, Intelligence Bureau (IB)..Gupta has contended that his repatriation to IB despite IB giving NOC for his continuation in CBI is due to the fact that he was one of the officials who along with AK Bassi unearthed crucial findings against Rakesh Asthana in the Sterling Biotech case..As per the application filed through advocate Sunil Fernandes, Gupta joined IB in 1999. He served in various places before joining CBI in deputation in January 2014. The deputation was initially for three years. The same was extended for one year until June 2018 after obtaining no objection from his parent organisation, IB..The CBI again sought an extension of Gupta’s tenure till June 2019 and write to the IB for the same. IB once again allowed the same and granted NOC in June 2018. The same was forwarded by the CBI to the DoPT for approval in June 2018 itself..The petitioner states that for Class I officers in the organisation viz the rank of DSP and above, like the applicant, once the parent organisation gives NOC and the same is accepted by CBI, the DoPT merely approves the proposal forwarded to it..However, to the applicant’s surprise, on October 24, 2018, the CBI repatriated the applicant to his parent organisation on the ground that the order of his extension was not received by CBI..Contesting this stance taken by the CBI, the applicant has submitted that the NOC from IB regarding the extension of tenure of the applicant was received by the CBI in June 2018, before the expiry of applicant’s deputation period. The same was forwarded to the DoPT for its approval in June 2018 itself, the applicant states..Gupta has then alleged that the real reason for his repatriation to IB is due to the fact that he was one of the officials who had unearthed crucial findings implicating Rakesh Asthana in Sterling Biotech case..“The singling out of the Applicant herein is due to the fact that the Applicant was one of the officials carrying out investigations along with Shri. AK Bassi which led to the unearthing of crucial findings implicating Shri. Rakesh Asthana in the Sterling Biotech case….”.The petition also adverts to a similar application made by Bassi wherein Bassi has stated as to how “he was victimized and penalised by his transfer to Port Blair Andaman for discharging his duties conscientiously.”.The application then proceeds to set out details with respect to the investigation in the Sterling Biotech case including the averment that during Income Tax Raids at the Sandesara Estate of Sterling Biotech, “23 suspected entries were found for a total amount of Rs. 39,472,106 with respect to Shri. Rakesh Asthana..”.Gupta has prayed that the repatriation order which is malafide and unjust, be quashed.
