Jokes that were shared in Supreme Court corridors about Calcutta High Court passing orders from Supreme Court seems to have come true..In a bizarre turn of events, Justice CS Karnan of Calcutta High Court has passed a judgment sitting in New Delhi restraining the seven Supreme Court judges, who heard contempt case against him, from performing their judicial and administrative work..The judge has also accused the seven judges of “heinous crime” under the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act..“This Court (I) request the Registrar General not to allot any judicial or administrative work to the above mentioned Hon’ble judges since they have violated their judicial and administrative power by their inappropriate and unlawful orders undermine the very sanctity and dignity of the Supreme Court, hence I declare all the 7 judges as contemnors.”.The judge has further gone ahead and stated that if the seven judges pass any judicial or administrative orders, they shall not be acted upon by the litigants or accepted..The judge has also directed the Registrar General of Supreme Court to deduct Rs. 50,000 per month from the salaries of the seven judges until an amount of Rs. 14 crore, which he had demanded as compensation from them, is realised..Bringing up the issue of which of the orders receive precedence over the other, Justice Karnan’s order says,.“Parliament becomes the competent authority to interfere with my judgment as well as the seven judges’ suo moto contempt order since there is no appropriate forum to challenge their order thereby causing a logjam..If my considered order is ignored by the Hon’ble judges, then the suo moto order passed by the said judges and which is a non-speaking order will be ignored by me.”.Regarding the inexplicable hearing that happened in Supreme Court today, Justice Karnan’s equally inexplicable judgment says:.“At the Supreme Court premises, besides the [Supreme Court] judges, one sitting judge of Calcutta High Court have occupied the first court hall. Therefore, the first court hall is consisting of the Supreme Court as well as the High Court. The Supreme Court is neither the master, employer or superior to dominate me as explained above likewise the Calcutta High Court is not a servant, employer or neither inferior both are equal as per the Indian Constitutional Law and all the judges are possessed of individual Constitution office.”.The judgment ends with allegations of violation of principle of Natural Justice and malafides against Dalit judge..With the Supreme Court not heeding to Justice Karnan’s request to restore judicial work to the maverick judge today, it remains to be seen if this judgment by Justice Karnan would have any impact on the proceedings..Image taken from here..Read Justice Karnan’s Judgment
