CBI Special Director Rakesh Asthana has moved the Supreme Court challenging the order by the Central government to send him on leave..The petition was filed through advocate Amit Anand Tiwary a few minutes back..The petition seeks to quash the directions dated October 23 by which Asthana was divested of all his functions as Special Director of the CBI. The directions are assailed as being violative of Articles 14 and 21 of the Constitution..It states that Asthana acted as a whistleblower to report the criminal misconduct and corruption committed by Alok Verma, and is being penalised for the same. It is further contended,.“The petitioner has been the victim of deliberate delay on the part of the Respondents (CBI and CVC) in taking action on the complaint dated 24.8.18, which led to Respondent No. 3 (Alok Verma) framing the Petitioner in a false criminal case to save his skin.”.Apart from quashing the directions to send him on leave, Asthana has sought an expeditious inquiry into the complaint he filed against Verma on August 24. Asthana has also sought a direction to the CBI to remove Alok Verma from the post of CBI Director “in view of his involvement in corruption and other criminal misconducts”.
