Breaking: Collegium modifies its decision, Justice Akil Kureshi recommended to take over as Tripura High Court CJ

In a significant decision, the Supreme Court Collegium has modified its recommendation to appoint Justice Akil Kureshi as Chief Justice of Madhya Pradesh High Court.

The Collegium has now resolved to appoint Justice Kureshi as Chief Justice of Tripura High Court.

The resolution passed by the Collegium on September 5 states that the Central government had returned the proposal to appoint Justice Kureshi to Madhya  Pradesh High Court twice. The two communications were received by the Collegium on August 23 and August 27 along with accompanying material.

Taking into account the aforesaid communications and the accompanying material, the Collegium has now decided to modify its decision.

The resolution reads:

“The said recommendation sent to the Government has been referred back to the Chief Justice of India vide two communications dated 23rd August, 2019 and 27th August, 2019 received along with accompanying material. These communications and material received from the Department of Justice have been placed before this Collegium.

On reconsideration and after taking into account the aforesaid two communications dated 23rd August, 2019 and 27th August, 2019 and the accompanying material, the Collegium resolves to reiterate its
earlier recommendation dated 10th May, 2019 with the modification that Mr. Justice A.A. Kureshi be appointed as Chief Justice of the Tripura High Court.”

In May this year, the Supreme Court Collegium had recommended that Justice Kureshi be appointed as Chief Justice of the Madhya Pradesh High Court.

Various other recommendations made by the Collegium after that were approved by the Centre except that of Justice Akil Kureshi.

The Gujarat High Court Advocates Association had filed a petition in Supreme Court taking objection to the Central government’s reluctance to appoint Justice Akil Kureshi as Chief Justice of Madhya Pradesh High Court.

When that petition was heard on September 16, the Supreme Court had told that a decision has been taken and will soon be published on the Supreme Court website.
