The Bombay High Court has issued notice in a PIL seeking, amongst other things, the implementation of the odd-even scheme in Mumbai..The petition has arraigned the municipal corporation, the Maharashtra Pollution Control Board, the Regional Transport Office,, as well as the state government as respondents..The petition states that the upper limit of a city’s air quality index (AQI) should be 160 whereas in Delhi it stands at 360 and in Mumbai it stands at 191..The petitioner, Shadaab Patel, says that the city’s residents are suffering health problems due to the pollution caused due to carbon monoxide emitted from vehicles, industrial waste, and the burning of solid waste by the city’s civic body..Patel’s petition also points out subsidiary problems faced by the people in city, for example ambulances unable to travel fast enough during peak traffic hours..Speaking to Bar and Bench, Patel sais.“The streets of Mumbai are congested, there is little option of space as it is, apart from the vehicular pollution, industrial waste is worsening the quality of air in the city. Ambulances are stuck in traffic for hours together” .This is not the first time Patel has approached the court; Patel was an intervenor in the petition filed against comedy group, AIB by a law professor Sharmila Ghuge..A similar petition was filed by the Bombay Environment Action Group regarding quality of air in the city and vehicular congestion. The petition had accused the government of disincentivising public transport..Although Jayant Bardeskar, Patel’s counsel maintained that his client’s petition was different from the one BEAG had filed, the division bench of V.M. Kanade and Revati Mohite Dere JJ directed the two petitions to be clubbed together..The matter will now be heard on February 28.
