Courts created by Executive notifications not akin to Special Courts: Madras HCJune 21 2018
The Madras High Court has clarified that Sessions Courts created by Executive notifications are not the same as Special Courts created by special laws. In view of the same, they cannot abridge or supersede the jurisdictional powers conferred by the Code of Criminal Procedure (CrPC).
Observations to this effect were made by a Special Bench of R Subbiah and G Jayachandran, while examining the jurisdictional nature of Sessions Courts designated “for exclusive trial” of bomb blasts cases, brought into existence through government notifications . . .
