The Bar Council of India (BCI) has today issued a show cause notice to Senior Advocate and former President of Supreme Court Bar Association Dushyant Dave for his remarks against Chief Justice of India Dipak Misra and the Collegium.
The BCI has asked Dave to file his reply within four weeks.
The BCI has also clarified that it is not in agreement with the decision of the Collegium to transfer Justice Jayant Patel and may join issue with the Gujarat High Court Advocates Association in the legal proceedings which are likely to be instituted in Supreme Court.
However, the BCI has taken the view that the remarks of Dave on the subject are baseless and reckless, and smack of a personal vendetta against the CJI.
The press release issued by BCI states,
“the baseless comments of Mr. Dave on TV yesterday is an attempt to malign the image of judiciary and the Institution. The personal attack smacks of some personal vendetta against the Chief Justice of India which amounts to gross misconduct”.
In a discussion on NDTV yesterday, Dave had stated that “independence of Collegium is only in name” and judges close to the ruling executive had been rewarded earlier too. Dave had then made allegations against CJI Dipak Misra which has now been taken note of by the BCI.
