Eminent lawyer and former bureaucrat, Abha Singh has filed a complaint before the Maharashtra State Commission for Women, alleging violation of human rights in the arrest of two girls who posted a comment on Facebook with regard to the shutdown of Bombay city for the funeral of Shiv Sena Chief, Bal Thackeray..Former bureaucrat and Lawyer Abha Singh has today filed a complaint before Maharashtra State Commission for Women, alleging violation of human rights as well as Supreme Court directives in the arrest of two girls who posted a comment on Facebook with regard to shutdown in the city for the funeral of Shiv Sena Chief Bal Thackeray..Earlier, Justice Katju has also written a letter to the Chief Minister followed by an email asking him to inform “why this arrest of a woman was made in Mumbai just for putting up an apparently innocuous material on the Facebook, and what action you have taken against the delinquent policemen and others involved in this high handedness and blatant misuse of state machinery.”.In his letter to the CM Katju said, “It is absurd to say that protesting against a bandh hurts religious sentiments. Under Article 19(1)(a) of our Constitution freedom of speech is a guaranteed fundamental right . We are living in a democracy, not a fascist dictatorship. In fact this arrest itself appears to be a criminal act since under sections 341 and 342 it is a crime to wrongfully arrest or wrongfully confine someone who has committed no crime”.
