Dr. Ram Manohar Lohiya National Law University, Lucknow, emerged as a Semi-Finalist at the 6th Ian Fletcher International Insolvency Moot, 2022, organized by INSOL International and International Insolvency Institute, held virtually between 12 March - 20 March, 2022.
The team consisted of Kashish Jain, Christina D’souza, Priankita Das, and Sushant Kumar, and was coached by Ahkam Khan. This was the first team from RMLNLU to reach the semi-finals of the competition.
The competition witnessed the participation of 38 teams from across the world, out of which only the top 16 qualified for the oral rounds after passing through the global memorial knockout rounds.
The oral rounds were held virtually during March 12-20, 2022, wherein the team from RMLNLU had competed against both the finalists of the competition – Monash University and National University of Singapore – during their preliminary and semi-final rounds. Eminent lawyers, professors, and Judges from 17 countries judged the rounds of the competition.
The moot proposition was based on the cross-border insolvency framework under the UNCITRAL Model Law and contemplated the recognition of foreign insolvency proceedings as a foreign main proceeding, and the recognition of judgments that are contrary to a State’s public policy.
The proposition raised questions about the shifting of company administration and headquarters for insolvency and restructuring purposes and the subsistence of set-off rights for counterclaims during insolvency proceedings.
Other teams aside from RMLNLU to have qualified for the oral rounds from India included SLS Pune, NLU Odisha, RGNUL Patiala, and NUALS Kochi.
