The Confederation of Alumni for National Law Universities Foundation (CAN Foundation) in collaboration with Dr. Ram Manohar Lohiya National Law University, Lucknow & National Law University Odisha, Cuttack will host the Second Justice HR Khanna Memorial National Symposium.

The Symposium is being organized to commemorate the colossal persona of Late Justice HR Khanna. It will be conducted on a virtual platform on 3rd July, 2022 which also happens to be the birth anniversary of Late Justice HR Khanna.

About Justice HR Khanna

While describing Late Justice HR Khanna, Nani Palkhivala said “for a man of the stature of Justice Khanna, the Chief justiceship of India could have added nothing.” Justice Khanna is widely recognized and respected for upholding the rule of law and for protecting the Fundamental Rights of the citizens even after several external influences attempted to stop him from doing so.

During his tenure as a Supreme Court Judge, Justice Khanna had delivered a catena of landmark judgements leaving an indelible imprint on the constitutional jurisprudence of the country. His dissenting opinion in ADM Jabalpur v. Shivakant Shukla that “personal liberty is the most precious Fundamental Right, and cannot be trampled upon even during the Emergency”, still serves as an inspiration to combat the tyranny of those in power.

His contribution to the Constitutional Principles of the country cannot be understated. His firm beliefs in upholding the rule of law and protecting Fundamental Rights while staying away from external influences come to the forefront, especially in today’s era. At a time when the Law of Sedition is being disputed and issues of Marital Rape are coming before courts, there is a need to emulate Justice Khanna’s virtues to ensure Justice is done.

About the Symposium

The Symposium shall see the presence of Mr. Justice Vikram Nath (Judge, Supreme Court) as the Chief Guest and Mr. Justice J.B. Pardiwala (Judge, Supreme Court) as the Presiding Guest at the Symposium.

Speaking about the Session, Siddharth R Gupta on behalf of the CAN Foundation stated, “Justice Khanna was the personification of all the virtues that a person occupying any high constitutional seat must have. Mere mortals yield to their personal aspirations and forego what is right. A titan such as Justice Khanna immortalized himself by refusing to be swayed by external pressures and upheld the Constitution to be supreme. The ADM Jabalpur Judgement has been overruled, but the memory of HR Khanna shall live on forever and shall serve as a testament to what one can achieve if one follows the path of righteousness. This Symposium is to honor his legacy and to remind ourselves of the contribution of a Judge, who truly saved India’s constitutional framework.”

The Esteemed Panelists shall be addressing the attendees on two overarching themes, namely, Fundamental Duties vis-à-vis Fundamental Rights under Our Constitution and Vox Populi vs. Rule of Law: A Balancing Act for the Supreme Court as the Final Court of Justice.
