Bombay High Court sets aside permission to Indrani Mukerjea to travel abroad

The Bombay High Court on Friday set aside the permission granted by a trial court to Indrani Mukerjea, a key accused in the Sheena Bora murder, to travel abroad [Central Bureau of Investigation v. Indrani Mukerjea]

Single-judge Justice Shyam C Chandak allowed the plea filed by Central Bureau of Investigation (CBI) against the trial court order.

Indrani Mukerjea, a former media executive, faces accusations of murdering her own daughter, Sheena Bora, in 2012. The trial court had previously granted her permission to visit the United Kingdom and Spain for a period of ten days, split across three months.

This decision was based on an email from her legal representative in the UK, which stated that her presence was essential for various legal and financial matters including settling taxes, updating her will and reactivating a joint bank account in Spain.

The email outlined specific reasons for her travel, including the need to amend her will to remove her ex-husband, Peter Mukerjea, as a beneficiary.

Additionally, she was required to complete biometrics at Banco Sabadell Atlántico in Spain's Marbella where her account had been rendered inactive.

During the hearing, Shriram Shirsat, the special public prosecutor for CBI, contested the travel request, citing information from the Ministry of External Affairs.

He argued that the tasks mentioned could be accomplished from India without the need for Mukerjea to travel abroad.

In response, Mukerjea's counsel insisted that Spanish civil law mandates her physical presence for these matters.

The defense also requested that if the court approves her travel, the trial court should be permitted to adjust the schedule for her case accordingly.
