31 vacant posts at NCLT, 2 at NCLAT; no notification for filling up of vacancies: RTI reply

NCLTs across India have 17 vacancies for Judicial Members and 14 vacancies for Technical Members.

As per a reply to a Right to Information (RTI) query, the Union Ministry of Corporate Affairs has revealed that there are a total of 31 vacancies at the National Company Law Tribunal (NCLT).

Responding to the application filed by lawyer Abhay Gupta, the Centre has also informed that there are 2 vacancies at the National Company Law Appellate Tribunal (NCLAT).

NCLTs across India have 17 vacancies for Judicial Members and 14 vacancies for Technical Members. There is 1 vacancy each of Judicial and Technical Members at the NCLAT.

The response stated that as per Section 412(2) of the Companies Act, a Selection Committee under the Chairmanship of the Chief Justice of India recommends names for appointment of members to the NCLT.

With respect to recommendation of names for appointment of members to NCLAT, the terms of Tribunal Reforms (Rationalisation and Conditions of Service) Ordinance, 2021 read with Tribunal Rules 2020 provide for a Search cum Selection Committee under the chairmanship of the CJI.

However, it is revealed that no notification or circular has been issued on the above vacancies.
