Bar & Bench

The Centre for Research and Studies in Human Rights (CRaSH), Dharmashastra National Law University, Jabalpur, is an endeavor of the University to respond to the emerging regime of Human Rights. The Centre endeavors to undertake interdisciplinary studies involving legal academia and the other stakeholders and contribute in the best possible manner to the global pool of knowledge on this subject.

The society even today believes that once married the spouses could not refuse consent and if there is consent then how can such a consented act of sexual intercourse be considered as rape. Marital rape violates a woman’s right to privacy and her right to live with dignity. It’s a disgraceful violent act committed against a woman. It's time to now question the exception of marital rape in the realm of the basic human right of consent.

What we seek to understand now are the intricacies of the need for the criminalization of the offense, the aspect of infringement of various fundamental rights of married women, the global concept of consent, and ultimately the impact or implications of such a move on the institution of marriage.
