In the Supreme Court today, Attorney General for India KK Venugopal said that the Centre is ready to extend the deadline for linking Aadhaar with various services (for those who have not enrolled for Aadhaar) till March 31..The AG mentioned the matter before a Bench presided by Chief Justice Dipak Misra and comprising Justices AM Khanwilkar and DY Chandrachud..The Centre’s note states that the Committee headed by Justice BN Srikrishna, which is deliberating on a Data Protection Bill, is also in the process of making comments on the Aadhaar Act. In the meeting of the Expert Committee on October 16, it was resolved,.“They [working groups] should also suggest changes that may be required, if any, to other allied legislation such as the Aadhaar Act, 2016 or the Information Technology Act, 2000.”.The Committee’s next meeting will be held on November 7. In light of this, the Centre has decided to extend the deadline for linking Aadhaar to various programs till March 31 next year. The note specifically states that the same would be applicable only to those who are not enrolled for Aadhaar..Senior Advocate Shyam Divan, appearing for the petitioner, however stated that the extension of the deadline should apply not only to those who do not have Aadhaar, but to those who have already enrolled as well. He said,.“Let them make a statement that there would be no coercion whether one has Aadhaar or not.”.He also submitted that the matter should be listed for final disposal in November..“If he wants to extend the deadline, fair enough. But the matter has been pending for final hearing since long and hearing is imperative.”.The Attorney General said that he will take instructions on whether extension of deadline can be made applicable for those who have already enrolled and sought permission to mention the matter again on Monday next week..The same was allowed by the Court..Despite a clear mandate by the Court by its August 11, 2015 order that the scheme cannot be made mandatory, the central government has been coming out with one notification after another in violation of Supreme Court orders..A number of challenges to the Aadhaar scheme are pending in the Supreme Court; petitions have been filed challenging the validity of Section 139AA of the Finance Act, which mandates linking of Aadhaar with PAN numbers, the linking of Aadhaar with 17 different social security schemes, and the linking of Aadhaar with mobile numbers and bank accounts..Read the Centre’s note:.Click here to download the Bar & Bench Android App
