2G Scam: Delhi HC directs plantation of over 15, 000 trees for failure to file replies in CBI, ED appeals

In a bid to impose costs on respondents who are yet to their replies in appeals preferred by the Central Bureau of Investigation (CBI) and the Enforcement Directorate (ED) against the trial court’s acquittal in the 2G case, the Delhi High Court has called for a tree plantation drive in Delhi’s South Ridge forest area..The order was passed today by Justice Najmi Waziri..Swan Telecom promoter Shahid Balwa; Director of Kusegaon Fruits & Vegetables Pvt Ltd, Rajiv Agarwal; companies DB Realty, Dynamix Realty, and Nihar Construction, have been directed to plant 3,000 trees each for their failure to file replies in the ED’s appeal against their acquittal. Other respondents were also directed to plant a certain number of trees..The parties have been directed to approach the Deputy Conservator of Forests on February 15 for allocation of land on which the planting of trees is to take place..The plants are to be of nursery age 3 and half years, 6 feet in height, and of indigenous variety. Justice Waziri stated the specifics while directing the parties to carry out the plantation drive before the next date of hearing..The parties have further been directed to ensure the upkeep and maintenance of the plants till the upcoming monsoon..To ensure compliance, Court directed the parties to submit photographs of the same..“This is the best way to impose costs“, said Solicitor General of India Tushar Mehta..Stressing on the need to revive the 48,000 acre of ridge area in New Delhi, Justice Waziri stated that till date, he has passed similar orders for planting of almost 39,000 trees..The parties have now been given a final opportunity to file their replies within two weeks..The CBI and the ED had moved the Delhi High Court almost a year ago, in March 2018 against the acquittal of all 17 accused persons in the 2G case in December 2017..The respondents were represented by Advocate Vijay Agarwal..The matter will be next heard on March 26..Read the order:
