It would appear that the Supreme Court of India is reluctant to change the basic procedure currently followed for designating lawyers as Senior Advocates..And a lengthy discussion between Chief Justice TS Thakur and SCBA President Dushyant Dave that took place today, in the case relating to the designations challenge, points towards the same..The PIL filed by Senior Advocate Indira Jaising came up for hearing as item 1 in court 1 today, with both Jaising and Attorney General Mukul Rohatgi not present in court..SCBA President Dushyant Dave, who was present, appealed to the court for the cause of young lawyers..“There are lot of youngsters (at the Bar). Your lordships should encourage them. We can sit together and jointly revise the process (for designating Senior Advocates), he submitted..Justice Thakur, however, made it clear that the final call would be with the judges..“Can we have any other system? You tell us. We can take the opinion of the Bar….but ultimately decision has to be with the judges”, he said..He also said that Bar could form a committee of sorts and the Court could take into account the views of the committee. Dave agreed to this, and said that a system where the Bar’s or the Attorney General’s “voice could be heard” would be desirable..The matter was then adjourned..Though advocate Anindita Pujari requested that the matter be posted for final disposal on a non-miscellaneous day, the request was rejected. The matter will now be heard on October 17.
