Senior Advocate Indira Jaising will move the Supreme Court seeking status quo on designating lawyers as Senior Advocates till the petition filed by her praying for guidelines for Senior designations is decided..This development came about after Jaising mentioned the case before Chief Justice of India, Justice JS Khehar today..Even before Jaising could make her request for early listing today, Justice Khehar told Jaising that he has already constituted a Bench..“We have already done it”, said Justice Khehar..Jaising then proceeded to raise a few other issues regarding the matter..She said that notice must now be issued to all High Courts and Bar Associations of High Courts since the Court indicated in its order yesterday that all stakeholders must be heard..Besides, Jaising also conveyed the concern raised by the Bench presided by Justice Ranjan Gogoi that the affidavit filed by the Registrar General of Supreme Court did not reflect the views of the full court. Jaising therefore, requested the CJI to direct the Registrar General to file an additional affidavit reflecting the views of the full court..Importantly, Jaising also asked the CJI to maintain status quo during the pendency of the petition so as not to “compound the frustration”..The CJI asked Jaising to file an interim application instead of making the requests orally..Jaising will now soon file an interim application in this regard..Yesterday, a Division Bench of Justices Ranjan Gogoi and Navin Sinha had heard the matter before ordering that the matter be placed before the Chief Justice so that he can constitute a larger Bench to hear the case. The Court had also noted that since it’s decision in the case could have wide ramifications, Bar Associations of High Courts across the country should be heard..Importantly, answering the question on whether designations should be made in the interim, the Court said that it is leaving the same to the discretion of High Courts and the Supreme Court.
