In a move that can be seen as a sign of defiance against the CJI’s office, a Bombay HC judge whose name was included in the list of mass transfers, has submitted his resignation papers to President Pratibha Patil..In a move that can be seen as a sign of defiance against the CJI’s office, a Bombay HC judge whose name was included in the list of mass transfers, has submitted his resignation papers to President Pratibha Patil..Justice Rajiv Shyamrao Mohite who was supposed to be transferred to the Patna High Court, had reportedly asked for some time off before assuming his new post due to urgent family related concerns. Justice Mohite’s request was apparently turned down, which prompted him to tender his resignation citing ‘personal reasons’..Justice Mohite who was appointed as an Additional Judge in 2001 was amongst the youngest judges to be appointed as a Judge in the Bombay High Court. He completed his legal education from the Government Law College, Mumbai and enrolled as an advocate in 1978. Justice Mohite was well known for promoting liberal causes and had also set up a charitable trust known as the ‘Legal Aid Society of Bombay’..Last week, the CJI had created a flutter when he had undertaken a mass transfer of High Court judges espousing ‘public interest’ as the only reason. A lack of clarity in defining the reason has already raised some voices regarding transparency. As it was earlier reported, there were other judges too who had put in requests regarding their new postings which had been turned down by the collegium..With the shortage of judges and cases piling up, any further acts of defiance by the judiciary will be seen as a big step back in improving the state of the national judiciary. It would be a terrible irony given the fact that the CJI has been widely lauded for taking tough steps in an attempt to over haul the Indian judiciary system.
