Delhi University’s Law Faculty appears to be in troubled waters once again..The Delhi High Court recently issued notice to the University over a plea questioning the empanelment of guest, and part-time lecturers in Law..Advocate Jamshed Ansari who filed the petition, argued that the Notification issued by the Faculty of Law was utra-vires and liable to be struck down. Highlighting a specific clause, that outlined qualifications for a candidate to be eligible for selection as a guest lecturer, the petition went on to state:.“….Ordinance XIII-B (of the Notification) prescribes essential qualification for part time lecturers in Law which will be “(a) at least a Bachelor’s degree in Law with not less than 50% marks or equivalent grade-point average; and (b) not less than five years of actual practice as a lawyer at the High Court level”. But the Respondent allowed applications from candidates who need not have at least 5 years of actual practice.”.The petition further went on to state:.“The violation on the part of the University of Delhi has led to considerable deterioration in the standard of legal education in the premier institution.”.Ansari, who had applied to the University pursuant to the said notification, found his name to be missing in the list of shortlisted candidates who were to be interviewed as prospective guest faculty..Speaking to Bar & Bench, Ansari said that the University failed to include his name in the list despite his eligibility for the said post. He also mentioned that some appointments had already been made after the said interview was conducted..The Bench of Justice VK Rao sought a reply from the University and posted the matter for further hearing on August 21.
