Supreme Court designates 15 retired High Court Judges and 2 Advocates as Senior Advocates

The Full Court of the Supreme Court designated 15 retired judges of various High Courts and two practicing Advocates as Senior Advocates with effect from November 21, 2012 . The 15 retired High Court judges include 4 from Allahabad High Court, 3 from Kerala High Court, 2 from Patna High Court and 1 each from Punjab & Haryana, Bombay, Rajasthan, Madhya Pradesh, Gujarat and Andhra Pradesh High Courts..The Full Court of the Supreme Court designated 15 retired judges of various High Courts and two practicing Advocates as Senior Advocates with effect from November 21, 2012 . Section 16(2) of the Act stipulates that, “An advocate may, with his consent, be designated as senior advocate if the Supreme Court or a High Court is of opinion that by virtue of his ability [standing at the Bar or special knowledge or experience in law] he is deserving of such distinction.”.Also, Article 220 of the Constitution of India allows a High Court Judge to plead or act before the Supreme Court or any High Court other than the one where he was a permanent Judge..Out of the 17 people designated as Senior Advocates, only two of them are practising Advocates. The Apex Court has a very rigid procedure when considering applications of practising advocates to be designated as Senior Advocates. In an article in The Hindu, J. Venkatesan notes, “As per the rules, a minimum of five sitting judges are expected to recommend the candidature of a practising advocate. Upon such a recommendation, the application is placed before the Full Court.
