The National Green Tribunal (NGT) has prohibited parking of cars on metalled roads in Delhi and any violation of this direction will attract a fine of Rs. 1000..The order was pronounced by a Coram which comprised of Chairperson Justice Swatanter Kumar, Judicial Member Justice MS Nambiar and Expert Members DK Agarwal and AR Yousuf..Taking into account the report on ambient air quality submitted by an Expert Committee, the NGT concluded that,.“ambient air quality in Delhi NCR is highly polluted. Obviously it is dangerous to human health and environment. These statistics clearly show that drastic measures need to be taken, if the residents of NCR Delhi are to be protected against health hazards arising from air pollution. We direct that all the directions issued by the Tribunal, particularly in relation to the vehicular pollution shall be carried out by all the concerned agencies without delay and default.”.It then proceeded to hold the following:.“It will be ensured that stagnation of vehicle and traffic congestion are avoided particularly by prohibiting parking on the main roads or any parking area on the metalled roads. We direct all the SHOs concerned, the Traffic Police and the concerned Corporation to ensure compliance of these directions without any default. There will be complete prohibition of parking of any cars on the metalled roads and the corporation would take strict action against the persons who violates it. This shall include payment of Rs. 1000/- per car on account of compensation for degradation of environment and its restoration. This would also be charged on the cars, which are parked on the metalled roads.”.It then directed the Corporation to submit a complete and comprehensive report in relation to both the markets of Lajpat Nagar and Karol Bagh, which have been taken to be pilot projects..The NGT has also directed the State government, Delhi Development Authority and the Municipal Corporation to identify places where multi-level parking facilities can be constructed so as to resolve the problem of parking..It has, further, appointed fourteen lawyers as Local Commissioners to visit the pilot project areas and submit their reports before the Tribunal with regard to compliance of its order pertaining to car parking on the metalled roads and air pollution in those areas caused by traffic congestion..The tribunal has also reiterated its early direction of December 4, 2014 that vehicles which are more than fifteen years old will not be permitted to ply in Delhi..The matter is now listed for February 25..Read the complete order below.
