What Mr. JethMalani said about the death penalty through an illustration is exactly what is called as rarest of rare case. In India, another substitute of naming death penalty is that only i.e., rarest of rare doctrine. In all likelihood, cases as such, only fall under the garb of established doctrine and are subjected to intensive scrutinisation so as to confirm the nature of crime.
Hence, it is humbly submitted that the gesture made by Mr. Jethmalani is nothing but an other way round nod to the existing mechanism of death penalty and an answer in affirmative to the question asked. He just played it smartly so as not to hurl any unpopular opinion. After all this interview is not a legal one but is more than that. He is counted among the biggest performer in this carnival of democracy (aka general elections) and is known fro his flawless performance. This is just a trailer that to a teaser one. Sit tight.
Ps. Rainmaker personality like Mr. Jethmalani never worry about what should stay and go as long as the area concerned is criminal law, is what i believe.
