The Bombay High Court has granted an ex-parte injunction restraining a local manufacturer from infringing Hindalco’s trademark ‘Freshwrap’ and copyright in respect of artistic works and acts of passing-off of their products, ‘Fresshpack’..The Bombay High Court has granted an ex-parte injunction restraining a local manufacturer from infringing Hindalco’s trademark ‘Freshwrap’ and copyright in respect of artistic works and acts of passing-off of their products, ‘Fresshpack’..Hindalco Industries Limited, flagship company of the Aditya Birla Group, is the world’s largest aluminium manufacturing company and has annual sales of more than $5 billion (Rs. 22,500 crore)..The Court also passed an Ex-parte order appointing the Court Receiver to take possession of the infringed goods pursuant to which raids were conducted in Mumbai and Pune at 21 places and the infringed goods were seized by the Court Receiver. DH Law Associates represented Hindalco and was also involved during the raids that were conducted at the premises..Partner Sidhartha Shrivatsava led the team from D.H. Law Associates along with Associate Partner, Sarojini Patil and Associate, Umang Jaju. Speaking to Bar & Bench, Sidhartha said, “Hindalco was being affected by continued counterfeiting of its products.These raids indicate the seriousness of the company against counterfeiting its products”. According to a Financial Express report, metals counterfeit causes companies to lose nearly Rs. 60 billion ($1.3 billion) every year. A FICCI survey has estimated the loss of revenue to the Indian exchequer by way of taxes to be roughly around Rs. 1,000 crore ($216 million) a year.
