Senior Advocate Aman Lekhi appeared for Siddharth Behrua..The Counsels held the Supreme Court order pronounced on November 23 as their Big Blue book and argued by quoting and re–quoting the observations made in it and used Article 141 as a tool to bind the High Court by it..The Counsels took a strong stand while arguing, on the precedent based on Article 141 of the Constitution expounded by the Supreme Court stating, “when the Supreme Court decides a principle it would be the duty of the High Court or a subordinate Court to follow the decision of the Supreme Court and a judgment of the High Court which refuses to follow the decision and directions of the Supreme Court or seeks to revive a decision of the High Court ,which had been set aside by the Supreme Court is a nullity”..They further argued on the ‘Principles of Parity’ that is ‘Likes should be treated alike’.
