“Community Standards test” will apply with greater vigour for “historically respected personalities”, Supreme Court

The Supreme Court yesterday held that “Contemporary Community Standards Test” will apply with greater vigour and in an accentuated manner when it comes to “historically respected personalities”. In the process, it justified the initiation of criminal proceedings under Section 292 of the Indian Penal Code against the author of a poem which contained allegedly obscene references to Mahatma Gandhi.
