The Supreme Court has today asked the Central government to consider the possibility of a uniform welfare measure for advocates’ clerks, in a Public Interest Litigation filed by the Supreme Court Bar Clerks’ Association (SCBCA)..The case was heard by a Bench presided by Chief Justice TS Thakur and including Justices AM Khanwilkar and DY Chandrachud..The Bench also asked the states who have not responded to file their response..Senior Advocate Dushyant Dave, who appeared for the petitioner, submitted that two States have responded negatively to the suggestion of welfare measures – Mizoram and Bihar..He also said that Kerala had a robust mechanism in place, while Andhra Pradesh was the first state to frame such a law in this regard..The court then proceeded to direct the Centre to consider a uniform measure in the light of the mechanism already in place in certain states..Speaking to Bar & Bench on the direction given by the Supreme Court, Dushyant Dave said,.“It is a good move forward. These people are completely unregulated and unprotected. If the state comes out with social security measures, it will be good for them.”
