A Division Bench of the Supreme Court comprising Chief Justice K.G. Balakrishnan and Justice Deepak Varma ordered on Friday that Muslim women who do not wish to be photographed need not vote.
Petitioner M. Ajmal Khan argued that the Election Commission should not photograph Muslim women, as it is violative of Article 25 of the Constitution. Khan contended that the Holy Quran stipulates that only family members can see the face of a Muslim woman.
Media reports indicate that Muslim clerics and organizations are in support of the Supreme Court's observation that Muslim women ought to shed their burqa to be photographed for electoral role verification. The Madras High Court in 2006 had dismissed Khan's petition filed after the EC started printing electoral rolls with photographs of voters.
Khan's team of counsels comprising P.N. Ramalingam, V.Balaji and Pravesh Thakur were countered by a battery of counsels including Additional Solicitor General Mohan Jain and the EC's standing counsel, and Kachwaha's outside counsel, Meenakshi Arora. Senior Counsel Gopal Subramaniam appeared for the Union of India. Other counsels included Balaji Srinivasan, V. N. Subaramaniam, Madhusmita Bora, Prateek Jalan, Prabhat Kumar, Anil Katiyar, and B. Krishna Prasad.
The SC has posted the matter on February 22 for final disposal.

Acting contrary to the Provisions of Constitution is Showing disrespect to the country.As india is home of many religion and thus there are various beliefs and practices but we should not forget that country should run on legal norms and not on Religious beliefs.There is nothing wrong in having Muslim Womens Photos on ID Card. this is not issue to fight with our own people and government.The Government didn't have any wrong intention behind it . it is rule applicable to all over india. So Muslim Women did not feel any regret of this Rule. and i think they should support the existing rule rather than standing against it. It is not going to cause any injustice to them, and not going to affect their identity as such . we do need Muslim Women support in this Matter and let them aware that Constitution which is Surpreme law of land come first and then comes our religion. Both are there for our benefit guiding us everytime by the principles enshrined in it.and we must show our due respect to them even in situation of crises between the religion and Constitutional norms. and one should not forget that constitution is the Supreme law of Land and thus preference should be given to it. Muslim Women are educated and can rationally decide and think on issue of having photo on voting id.Let them tell to the court of whether this is affecting there personal or Proffessional life any way. and if the answer to this Question is negative then there is no problem as such to observe this rule further.". - 3. "SC has rightly enacted its part in denying votes to the ones who resist to be photographed. The Voter Identity Card barely needs a copy of this. This card has its multiplicity of uses. The Muslim brothers and sisters should remember that they have to caste their votes in favour of their choiceable candidates to rule. They have to exercise their right to franchise and honour the constitutional duties. They are very much part of the polity. Hence, if they do not vote without this V.I. Card their demands shall remain unheard of in the wells and corridors of legislature.Even though to uncover purdah is prohibited in their religion their identity is their inclusiveness in the secular nation.Option is theirs.".
