Sir, My son taken admission in B.Tech 1st Year in ABES(IT) Gaziabad,U.P. a Pvt Engg Institute) through UP TU Lucknow and deposited full fee Rs. 1,40,000/- with other fees. After a day he left the college. I wrote a letter to the Registrar of the Institution to cancel the admission of my son and return all original documents and refund fee but neither he return the documents , nor fee even not give a reply of my letters. I appeal in consumer court at Jhansi. He replied that case can not be filed in consumer court at Jhansi as it do not comes under his jurisdiction. Is it true ? Please advise . In this connection I have to say that my son appear in entrance exam at Jhansi conducted by UPTU Lucknow . Counseling held at Jhansi. I belongs to Jhansi than why I can not file case at Consumer Court Jhansi . Pleas advise.

The establishment of Consumer Courts at various levels is basically to meet the international standards set by United Nations Organisation.Calling for members from various fields is to build up a jury system by giving a power of vote to non judicial members. This is a fine mix of judicial opinion and public opinion at large.The present rules as to procedure and practice to be adopted is inadequate. Moreover, the term deficiency of service in contradistinction to doctrines of arbitrariness, breach of contract, unconscienable bargain, monopoly, restrictive trade practices is not clearly defined. The Supreme Court offcourse had made an attempt in Ravneet Singh Bagga judgement but it is not sufficient. We want more such judgments defining the jurisdiction, distinctions, limits etc of the Consumer Court in all fields of services.
