Justice Dinakaran has been admitted to the Fortis hospital in Bangalore. Justice Dinakaran, was transferred on Friday to the Sikkim High Court.
Bar & Bench had reported that the Acting Chief Justice of the Delhi High Court, Madan Lokur, would replace Justice Dinakaran. However, with the change in mind from the Supreme Court collegium, the front-runner to the post seems to be the Chief Justice of the Uttarakhand High Court, Justice J. S. Khehar. Justice Khehar was appointed as the Chief Justice of Uttarakhand just four months ago. Justice Khehar, who is known for his tough decisions, may be confirmed as the Chief Justice of the Karnataka High Court as the Chief Justice of India, Balakrishnan feels that the entire Karnataka High Court is in shambles.
The Sikkim Bar is protesting the appointment of the controversial judge as the Chief Justice of the Sikkim High Court. The Sikkim Bar Association has said that the State is not a dumping ground for tainted judges and has called for a total boycott of the swearing in ceremony if Justice Dinakaran indeed takes up the appointment.
Several eminent jurists and previous Supreme Court judges have expressed their concern over this issue with former SC judge, Justice V.R. Krishna Iyer writing an editorial in The Hindu calling for the application of penal law to judges as well.
There were also unconfirmed reports that Chief Justice Dinakaran is planning to go on a hunger strike, which was denied by the High Court registrar. While we wait for the next move from both the Supreme Court collegium and Justice Dinakaran, the Global Council for Indian Christians has come out in support of the Chief Justice and has asked the President and the Supreme Court to publish the reports of survey of India in order to bring finality to the issue of land encroachment.
Whatever be the outcome of the Dinakaran dispute, the confusion over the appointment and transfer of Chief Justices or Judges of the Supreme Court has caused enormous embarrassment to the entire nation.
