Justice D.V. Shylendra Kumar of the Karnataka High Court has, in an editorial published in the New Indian Express, expressed his disappointment about the controversy over Judges and the Right to Information Act.
Taking a stand against the Chief Justice's views, he writes, "... the Chief Justice of India does not have the authority to speak for all other judges of superior courts, whether of the Supreme Court or the High Courts, unless any of them have either confided in the Chief Justice or have authorised him to speak on behalf of others also." (New Indian Express, 20th August 2009)
Substantiating his stand, he points out that despite other members of the judiciary maintaining silence on the issue, implying consent to the Chief Justice's view, a majority of the judiciary are quite willing to declare their assets.
Appealing to the brother Justices of the superior courts, he asks them to provide information voluntarily. He ends the article with, "The Judges have nothing to fear; they have nothing to hide and they have no hesitation to disclose particulars of their assets and even throwing open the information in the public domain".
