AIBE Update BCI to conduct next AIBE without external agency ITES Horizon to assist BCI

The Bar Council of India (BCI) has today confirmed that the BCI will itself conduct the next All India Bar Exam (AIBE) scheduled for November 25, 2012 with the assistance of Noida-based, ITES Horizon.

ITES Horizon is involved in IT implementation and delivery for nearly 13 years.

 

BCI Chairman Manan Kumar Mishra had earlier told Bar & Bench that, “If the BCI cannot finalise the agency soon, then we are ready to conduct the exam ourselves".

 

The BCI as per its notification dated June 23, 2012 had called for tenders from “consultant expert agencies” to hold the next AIBE. BCI had received tenders from four agencies including Rainmaker and Pearson. However, BCI has not been able to finalise with any of these agencies.

 

As confirmed earlier, the BCI will conduct the next AIBE on November 25, 2012.

So where is the hue and cry now for the appointment of ITES Horizon? When Rainmaker was appointed, there was such a great hue and cry and accusations of nepotism? Now this entity has been appointed, literally popping up from nowhere to conduct the Bar Exam and suddenly there is complete silence? If this is all about software implementation etc., then how come everyone is now comfortable with these chaps? Well I tried going through their website and guess what? There is no information on who owns this company or runs it or their antecedents. Nothing out there (and everything not out there) gives one a sense of comfort of their expertise to run the show? For someone who is going to provide additional help (lord knows what that means)and which is an ITES implementation company, their own website does not work and there is no evidence of any sense of expertise. And what are they going to be paid? Where are all the RTI applications that were filed when Rainmaker was conducting the exam, Mr. Raghul? What is ITES Horizon going to do? And where is that outrage over non-tendering this position? Why weren't other IT companies considered? Surely, there are enough and more with expertise in this area.Neither does Bar and Bench or anyone out there question this or wait a minute, Bar and Bench only hunts down Rainmaker, no one else. Well, as I have always maintained these are attempts to consign the Bar Exam to the dustbin. And if today, I am questioning the BCI's competence to do, I also do it on the basis of the statements of the "boys" helping them out. Clearly, the BCI realised that it could not conduct this exam on its own and contracted Rainmaker at that time for conducting the Bar Exam. Surely, things have not changed to such an extent that they can now do it.And would it not have been better for BCI to stay away from conducting the exam themselves? Any issues now with the Bar Exam will make them directly responsible. So, effectively now we are awaiting BCI's organisational capabilities to display itself at the cost of young lawyers. Why should I not be worried.All this flip-flop just does not do justice to an important examination like the Bar Exam. Imagine the hue and cry if the CLAT did this or IIT-JEE mucked around like this? Instead of protests against the Bar Exam, these protests should be focussed on the cavalier (or is it callous?) attitude of the BCI in respect of the conduct. Their flip-flops are the ones that are impacting the next generation of lawyers not the conduct of the Bar Exam itself. I am no longer just a bored lawyer, I am frankly a very depressed lawyer at these developments. RIP Bar Exam.

@Bored Lawyer: My attempt was only to bring in transparency and I have nothing personal against Rainmaker. I will be filing an RTI soon to get the details on the selection of this company to assist BCI in conducting AIBE. Further I am also collecting more information on this new company. I will keep everyone informed about the developments.

@Raghul, We can get the details about the company from ROC website. Any how there is a good lobby for stopping the exam scheduled for Nov 25th, More than 1500 advocates enrolled by Madras Bar Council are yet to receive enrollment number so it is a matter of time some one knocks the door of Madras HC to stop this exam. Just watch and enjoy.
