CBI to question Retired Bombay HC Judge after lawyer Daughter arrested for seeking bribe

In a shocking revelation, the Central Bureau of Investigation (CBI) had yesterday arrested retired Bombay High Court judge S. B. Mhase’s  daughter Advocate Madhaveshwari for seeking a bribe of Rs. 30 lakh from the complainant to get him favourable order in a case now before the National Consumer Dispute Redressal Commission.  Madhaveshwari was arrested with her two accomplices, who were caught while taking the money. Madhaveshwari has been remanded to police custody till October 17.

Mhase’s  daughter Advocate Madhaveshwari for seeking a bribe of Rs. 30 lakh from the complainant to get him favourable order in a case now before the National Consumer Dispute Redressal Commission.  Madhaveshwari was arrested with her two accomplices, who were caught while taking the money. Madhaveshwari has been remanded to police custody till October 17.

 

The complainant, Surendra Borker has also mentioned the retired Bombay High Court judge’s name in the FIR who is currently President of Maharashtra State Consumer Dispute Redressal Forum, reports TOI.

 

According to DNA, the CBI sources said S. B. Mhase’s questioning is necessary because many times Madhaveshwari and Sunil Shirole, one of the accused in the case who is untraceable have mentioned his name during conversations with the complainant. They had allegedly spoken about how Mhase could make use of his influence to settle the case in the complainant's favour.

 

The complainant had approached the National Commission after his case was dismissed by the state consumer forum.The complainant was claiming a compensation of Rs. 95 lakh from a builder.

 

The CBI, in their remand application submitted before the Special Judge R.R. Deshmukh claimed that Madhaveshwari, in a recorded conversation, told the complainant that she would manage to get a favourable order from the National Commission through her father’s influence. She allegedly demanded Rs. 30 lakh for it.

 

The CBI after receiving the complaint from Borker had then laid a trap and arrested Somnath Sutar and Hansraj Singh who had come to collect the money. Both Somnath and Hansraj exposed that they had accepted the money on behalf of Madhaveshwari and Shirole. 

 

The CBI officials said members of the State and National Consumer Dispute Redressal Commission are also likely to be questioned.

 

These revelations by the anti corruption wing of CBI raises doubts over the officials of both State and National Consumer Dispute Redressal Forums and of course brings a bad name to the legal fraternity.

I differ with some of the comments above. While "Innocent until proven guilty" is a fundamental maxim of criminal jurisprudence, it does not (and should not) dictate an investigation. Investigations are based on suspicion and probabilities. Just from the bare facts - the daughter demands a bribe to procure a favourable order, the father who is a retired judge now PRESIDES over the State Forum, the bribe was allegedly taken to use the father's influence. This matrix of circumstances undeniably warrant further investigation. Whether he is guilty or not is eventually for the court to decide on the basis of the evidence and preponderance of probabilities before it. But do the circumstances reveal that it is PROBABLE that he was involved? Certainly!

Theis forum for consumer disputes entrusted with wast powers is making mockery of legal system by them selves as the retired judges and politically appointed members who have no knowledge over law is passing ordersaccording to their whims and fancies or due to extronious reasons. The same should be scrapped and civil courts should be entrusted with the adjudication or new courts should be set up for this.

Justice Mhase! I fall short of words when I think of describing this character. Apart from the corruption charges, whoever has ever appeared before him lately, will concur with me on his unstable mental condition too! He not only needs to be questioned by anti corruption sleuths, he desperately needs medical/psychiatric counseling. Just one visit to his courtroom in the State Commission, would prove every statement of mine in the above lines. He should be sacked!

At this stage, it is wrong to caste any aspersion on S B Mhase.No one has alleged that he demanded money.No complaint or appeal was pending before him or before any bench of which he was a member.The allegations are that his daughter, an advocate, asked for money.She could very well be abusing her father's name snd position.I am afraid the present facts do not incriminate Mhase.During my 37 years service, I have across several instances where advocates and chartered accountants have takenMoney from assessees, in the name of income tax officers, though they never paid any thing to the cocerned officers.The irony is that the assessees suspected that no money was paid to the officers, but they were scared of the advocates And chartered accountants, and kept mum.

I do not disbelief the facts stated in the above report. It is a common fact across States that kith and kin of judges have at various times represented their ability to guarantee the nature of relief in cases. It is also common that litigants pay sky high fees to advocates who are known to be related to judges. Therefore, sometimes, you have young advocates with connections appearing in critical matters instead of seniors and pocketing fees as any similar would charge. Such practice must be deprecated and the law commission report on uncle judges should be considered seriously and expeditiously. However, I do agree with Dr Gupta that the demand by an advocate related to a judge or a representation by an advocate/person that he would procure a particular relief does little to suggest that the judge is actually involved.

My association with an anti-corruption association (an oldmen's club) and a few so-called consumer rights rotection groups opened my eyes to the realities of the insides of the NGOs who are as bad as the govt. if not worse. Power-crazy people never want to give up their positions in these NGOs for the clout these bodoies acquire over the years, with retired IAS, etc., civil servants thronging to join these bodies to continue to enjoy the importance they once enjoyed. Elections to these bodies of NGOs are mostly rigged with no intention to open the entry to the younger people to join these bodies. Coteries alone run and dictate these bodies. The reflection of this very acquisitive and monopolistic mindset is manifest in the selection of the members of the consumer bodies constituted by the govt. I was told by a retired chief commissioner of income tax that a very corrupt officer of this corrupt department was made a member of a district consumer forum! One can guess the extent of lobbying and pecuniary considerations involved in the selection. The CBI's action is welcome, though the people who become members of these bodies are too powerful with too many godfathers.
