The Division Bench of the Delhi High Court comprising of Justice A. K. Sikri and Justice Siddharth Mridul issued notice to the Delhi University (DU) and the Faculty of Law, in a writ petition filed by a law student, Aditya N. Prasad. Aditya sought an order from the Court for quashing the DU promotion rules as the rules are against the Advocates Act and the norms prescribed by the Bar Council of India on legal education.
The Petitioner, Aditya has also sought the directions from the Court to the Faculty of Law to hold supplementary exams in each and every semester.
The Court while hearing the Petition questioned as to "Why will LL.B. students, who are in second and fourth semesters, not be allowed to appear in supplementary examinations?"
Aditya filed the Petition on the ground that he was denied promotion to the final year of the three year LL.B. course. The University said that Prasad was not promoted as he did not pass in 15 subjects out of 20 in four semesters, which is mandatory, reports TOI.
Prasad, in his petition, said he cleared 13 out of 20 papers in his IIIrd semester examination and could not appear in examinations for other papers due to medical problems and as a result, he was not promoted to the final year.
The Petitioner submitted that he was ready to clear his papers to get into the final year but the University does not have a provision for supplementary examination in each semester, according to media reports.
The Court has directed the University to file a counter statement within the next 3 weeks, and the matter has been posted for further hearing on October 24, 2011.
