The Delhi High Court has issued a stay order on the publication and release of the book ‘Close Encounter with Nira Radia’ written by lawyer R.K. Anand. It is understood that the book covers details of the controversial tapped telephonic conversations of Nira Radia (pictured) with prominent political leaders, industrialists and journalists. The book has been published by Har Anand Publications and was scheduled for release in the first week of June. In a separate suit Nira Radia has also sued the author of the book, R.K. Anand.
The revelation of these controversial tapes had led to various arrests, including that of top executives of Reliance, Swan Telecom and Unitech as well as A. Raja, former Telecom Minister and Kanimozhi, daughter of former Tamil Nadu Chief Minister, Karunanidhi.
Justice V.K. Jain granted relief to Radia on her plea that the release of the book would cause irreparable loss to her reputation in the society. The Judge said, “The court is staying the release of the book ... the matter is sub judice”.
The civil suit was filed through a law firm, Khurana & Company on behalf of Radia’s public relations firm, Vaishnavi Corporate Communications. The plaintiff alleged that the book is written to sully Radia’s image and will depict her life in a ‘scandalous’ manner.
The Court also issued a notice to Har Anand Publications and has scheduled the matter for further hearing on July 22, 2011.
DNA reports the book described Radia as a “sprightly, bubbly and vivacious woman who at the age of 35 burst on to India’s political and business centre stage in the form of a whirling diva and whose every fervid gyration spun a web of cunning, duplicity and intrigue, ensnaring a veritable who’s who of those who run this nation’s business, political and journalistic empires”.
Earlier this year, Radia had approached the Delhi High Court seeking an injunction against release of a movie, ‘Monica - the Politics of Murder’. On her plea against the release of the movie starring Ashutosh Rana, the High Court had issued notice to its producer Kush Bhargava, a Lucknow-based Congress leader. She had sought relief on the ground that the movie depicted her private life in a scandalous manner.

In the preface of his book, R K Anand admits that he has been nurturing a grudge against Ms Radia. Mr R K Anand has infringed an individual’s fundamental right of privacy by using confidential & privileged information and documents that Mr Anand had obtained during course of his engagement as a Sr.Counsel for a company (KLM UK), represented by Ms Radia. His work is extremely defamatory in nature and is totally aimed at tarnishing the character of the lady.The book is based on series of fabricated data, promotes falsehoods and deception, thereby defamatory in nature.It is quite obvious that Mr Anand has misused his relationship with Ms Radia in his capacity as a senior advocate, who had access to confidential data, that otherwise is not supposed to be leaked to the public for malicious gains and intention.The book also details the ongoing trial relating to the kidnapping of Ms Radia’s son, the trial of which is at a critical juncture. The timing of publishing the book should therefore be noted as it aims to spread prejudice and influence judiciary to obstruct justice.It is also surprising to note that R K Anand did not even bother to contact or consult Ms Radia before publishing his defamatory work.
