Last week the CBI had arrested Bar Council of India (BCI) member RS Rana on allegations of corruption. Rana’s bail plea came up before CBI Judge OP Saini last week and refused to grant bail saying that "the probe is at its initial stage". Angry over the refusal to grant bail, a group of lawyers locked up Judge Saini for over an hour here.

Economic Times reports “that Judge O P Saini was also verbally abused by some 40-50 lawyers, who had gathered in the Patiala House courts in support of RS Rana. Upset over denial of bail to RS Rana, the lawyers led by some senior advocates kept the judge confined to his room and raised slogans besides hurling abuses”. They even tried to attack and manhandle CBI officials present there, the sources said.
Noticing the situation, some of the officials called the Registrar General of Delhi High Court after which additional police personnel were rushed to the courts, they said.
"Considering the serious nature of the allegations... recovery of Rs 1 lakh on the spot and incriminating material figuring in the transcription (of taped conversation) and other documents, I find that the prayer for police custody remand is justified," the CBI court had observed.
Justice Mukta Gupta had issued a notice to CBI and sought its reply by December 29 on Rana's submission that he was entitled for bail as his custodial interrogation by the CBI was over and verification of relevant documents are complete.
Meanwhile, the CBI has also registered a case against Bar Council of India Vice Chairman R Dhanpal Raj, whose house was also searched in connection with the case. |
UNI reports that Vice Chairman of the BCI, Dhanpal Raj (pictured left) was granted interim anticipatory bail by the Madras High Court for four weeks and directed him to appear before CBI for questioning. Dhanpal Raj's brother in law A Chandrasekar was also granted interim anticipatory bail.
Justice Aruna Jagadeesan directed him to furnish two securities of Rs 50,000 each and present himself before CBI whenever they asked.
In the meanwhile, a BCI Member speaking to HT said, "the BCI has decided to keep a moratorium on fresh inspections for the grant of recognition to law colleges across the country for the next three months". "The meeting passed a resolution to request eminent jurists Fali S Nariman, KK Venugopal and BV Acharya to be a part of the ombudsman panel to look into inspection-related complaints".
Speaking to Bar & Bench, Senior Advocate BV Acharya (pictured left) said, "although i have not received official confirmation regarding the ombudsman panel, i have been told that i am part of the 3 member panel".
He added "ultimately, the BCI should comprise of people with high integrity and professional ethics. Earlier the people who excelled in their practice, people of great stature would enter the Bar Council. These days, there is a trend that BCI has people who elect based on their groups who carry a vested interest. We need very high levels of transparency at all levels. There is a danger that BCI may become like the Medical Council with allegations of corruption within the governing body".
