The Supreme Court has upheld its remarks that “something is rotten in the Allahabad High Court and the High Court really needs some house cleaning”.
A Supreme Court Bench comprising of justices Markandey Katju and Gyan Sudha Mishra (the same judges who remarked about the Allahabad High Court), while dismissing the Allahabad High Court's application for expunging of the remarks, however, clarified there were "excellent and good judges too" in the Court.
The Allahabad High Court through an application urged the Supreme Court to take back the remarks stated by a Bench comprising of Justices Markandey Katju and Gyan Sudha Mishra. The application stated, that the remarks made in the Supreme Court order was a smear on the entire judicial system of Uttar Pradesh.
Senior Advocate P.P. Rao appeared for the Allahabad High Court.
The Times of India reports, rejecting the arguments of Senior Advocate P.P. Rao that even a clarification that some are excellent and good judges would still cause suspicion on the integrity of the judges, the Bench remarked, "It is not just time to react but also to introspect”.
Reacting to the persistent plea of Senior Advocate Rao that the clarification would not be sufficient, Justice Katju angrily retorted, "Do not tell all those things. I and my family have more than 100 years of association with the Allahabad High Court. People know who is corrupt and who is honest. So do not tell me all this”.
Justice Katju further observed, "Tomorrow, if Markandey Katju starts taking bribe, then the entire country will know about it. So do not tell me as to who is honest and who is corrupt”.
Bar & Bench previously reported of the incident which occurred during the judgment of Raja Khan vs. UP Sunni Central Wakf Board and stated that the Allahabad High Court is filing an application through its registry, against the remarks.
