AIBE Update: BCI meeting on November 20; practice rights may be given subject to passing the exam

The All India Bar Exam (AIBE) saga has taken on another twist. The Bar Council of India (BCI) in its last meeting has pushed the AIBE by 3 months to be held during sometime in March, 2011.

 

Unconfirmed sources have informed Bar & Bench that the BCI is scheduled to hold a meeting this Saturday, November 20, 2010 to discuss several issues including the AIBE.

 

The sources have said that the BCI is positive on taking the AIBE forward and that the exam will take place. One of the main issues to be discussed at the meeting is whether practice rights can granted to the students of the current batch subject to them passing the AIBE as an when it is conducted. With the delay of the AIBE, many students had spoken out against the delay in conducting the AIBE.

 

The feasibility of such a move of granting practice rights subject to them passing the AIBE has to be examined, as several questions still remain unanswered. What will happen to clients whose lawyer does not clear the AIBE, but has argued or filed petitions on behalf of them? Several such questions still bother several law students and more so from those who are keen on litigation practice. The weekend meeting hopefully would answer several of the questions of the students and provide answers to the confusion that prevails today.  

 

Yesterday, the National Delegation of Law Students had issued a press statement saying that in defiance of the delay of the AIBE, they will start their practice in courts next week without first writing the pre-requisite exam.
