AIBE Exclusive: Bar Exam delayed by 3 months

The All India Bar Examination (AIBE) has been further postponed by 3 months. The new date for the exam is yet to be disclosed. The exam will no longer be conducted on 5th December, 2010.

 

Speaking to Bar & Bench, Gopal Sankarnarayanan Convenor AIBE, said, “the Exam will be held after three months although no date has been finalized. The Bar Council is scheduled to meet later this week and decide on the modalities of the exam”.

 

Gopal Sankarnarayanan also said that the reason for the extension was delay by State Bar Councils in registering the law graduates, and delay in receiving the course material by the law graduates registered for the exam.

 

The Bar Council announced the introduction of the AIBE in June of 2010 and has been seeing severe resistance from several quarters including State Bar Councils and law students.

The problem in our country is that the babus in Delhi make the policy and want them to get it implemented at any cost.. but the problems at the grass root levels are not known to them.. exams were to be conducted in many languages apart from english, but they dint give much thought will they be able to publish materials in other languages..those who write in other languages are waiting for materials.. Since this was the first year, instead of getting things done in a hurry burry they should have done the homework well.. like when does all universities declare results, how long does it take for all state bar councils to get students enrolled etc..but they dint do it... "We agree things take time and no can can be blamed individually for what all has happened, still we most hubly request BCI and the Supreme authorities to review that (1) This exam itself shud be void ab initio, no other professional courses have such kind of exam after completing their degrees. (e.g. CA, engineer, doctor none). The exam may only be taken at the entrance level.(2) After passing the exams in 27 subjects in LLB, obtaining 48% or more if one has to appear in such exam it is very very disgraceful for this profession and line and existing lawers also.(3) Had there been a renumeration after passing this exam, from Govt. or BCI this exam might have been justified, but just to enrol & practice, struggle for couple of years in the vast competition and face the increasing unemployment this exam may be seen a discrimination of the Youth.(4) Majority is law. Therefore the learned authorities shud get a vote from the diff state Bar councils whether this exam shud be conducted or it is better to conduct an entrance exam before taking admission in law.(5) If none of the above concludes at least the present batch shud be exempted and the test may be from next batch theron, becoz the time factor counts and it is the question of thousands of law gradutes of the current year who ultimately are going to lead the nation in future. "This is the worlds greatest democracy where we have a "right to express" but then you can not make others to listen to what you have expressed....... all our hue and cries fall on deaf ears just like these comments being appreciated only by those who are facing these adverse situations.... its not that we dont want better people in the profession and that there should be a screening of those who are not serious but then only thing that i propose is to chalk out a better procedure. on the one hand the BCI stops us from practicing as an advocate on the ground that an exam will screen out those who dont belong to this profession but there is no obligation as it seems on the BCI towards the law graduates.I only urge the BCI the following:1. to pay heed to the loss being suffered by the us specially with regard to the period of experience.2. if BCI truly wants to have a team of good professionals in the field let the system be carved out where the fresh graduates be absorbed by the government departments and the government pleaders as a trainee for a fixed period and that they be paid a minimum subsistence what may be called as a stipend as in the case of medical students.3. to hit the roots that is the collages and monitor them with efficiency so that there is no question of lack of legal aptitude. if they fail to do so then they are actually shifting there burden on the students by conducting exams under the garb of coming out with the so called true professionals.There are numerous suggestions but then again we live in the "Greatest Democracy" with a golden right to the people i.e. "Right to Express" so keep on expressing because they are to fall on deaf ears.Thanks ".
