The upcoming Sanjay Dutt starrer Knock Out has run into legal troubles with Twentieth Century Fox Film Corporation (Fox) approaching the Bombay High Court seeking an injunction on the release of the film. The Hollywood studio has alleged copyright infringement and has said that the Hindi film is a near rip-off of their 2003 Colin Farrell starrer Phone Booth. The film is scheduled to release on October 15, 2010.
The film produced by AAP Entertainment Private Limited (AAP) is being represented by entertainment law specialist Naik Paranjpe & Co. whose team is being led by Partner Ameet Naik and Senior Counsel Iqbal Chagla. Producer of the film, Sohail Maklai is being represented by Senior Counsel Venkatesh Dhond while Fox is being represented by Neolegal Associates whose team is led by Partner Xerxes Ranina, Senior Counsels Virendra Tulzapurkar and Firoz Palkhivala.
Yesterday, a single judge Bench consisting of Justice Roshan Dalvi heard arguments by Virendra Tulzapurkar who said that after seeing the Hindi movie, the viewers are reminded of the Hollywood version. Countering allegations of copyright infringement, Iqbal Chagla argued that Knock Out was an original literary work and only one situation in the movie is common between the two films and that Fox is claiming copyright in idea, which is not copyrightable.
After hearing the parties at length, the matter has been placed on Wednesday, October 13, 2010 for hearing of Notion of Motion for ad-interim reliefs. According to media reports, the court has also ordered the producers of the film to hand over a copy of their movie’s screenplay to Fox.
